Delaware Becomes 22nd State to Legalize Adult-Use Cannabis
Breaking news – Delaware will become the 22nd state in the US to legalize adult-use cannabis.
Today, Delaware Gov. John Carney announced he will allow House Bill 1 and House Bill 2 to be enacted into Delaware law without his signature. These two pieces of legislation remove all state-level civil and criminal penalties for simple marijuana possession and create a highly regulated industry to conduct recreational marijuana sales in Delaware.
In Carney’s statement, he said “I want to make it clear, my views on this issue have not changed. And I understand there are those who share my views who will be disappointed in my decision not to veto this legislation. I came to this decision because I believe we’ve spent far too much time focused on this issue when Delawareans face more serious and pressing concerns every day. It’s time to move on.”
House Bill 1 – Removes All Penalties For Possession of Cannabis For Personal Use
As of Sunday, April 23, 2023 – Delawareans ages 21 and up will be able to possess up to:

- 1 ounce of dried flower
- 12 grams of concentrate
- or products with 750 grams or less of delta-9 THC.

“Adult sharing” is also allowed, which means you can transfer cannabis products to your fellow legal-aged friends as long as no money, reciprocal transactions, or contingencies are involved.
Home cultivation and consuming cannabis in public still remains prohibited.
Retail sales likely won’t begin for at least 19 months.
House Bill 2 – Establishes a Regulated Adult-Use Market
H.B. 2 will make Delaware the 22nd state to legalize a regulated and taxed cannabis marketplace in the U.S. This bill calls for state officials to issue an initial round of licenses that will include special license pools for social equity and micro business applicants.
